regarding appointment of judges in india, arguments against present collegium system is that
1. judges SELECT judges.
2. judges not accountable to public while political executive is responsible to legislature[indeed lower house].
i find little merit in these two arguments.
1. teachers select teachers[except ILI], legislature select prime minister etc, whats wrong in judges selecting judges. afterall who knows better than a legal professional about the competence, calibre, integrity of lawyers?
2. MP, MLA, ministers are accountable to public, but in last 65 years it is a sad picture. the way they ve exhibited their accountability in such an absurd and arbitrary manner that politics has become a dirty word. on the other hand the judiciary though not directly accountable in the sense legislature are, they successfully emerged as protector of human rights.
that way their is hardly any thing wrong in present system of appointment.
